Rep. Salo urges random drug testing for elected barangay/SK officials

Even before the winners in today’s electoral exercise for the barangays and Sangguniang Kabataan could be announced, Rep. Ron Salo, Kabayan Partylist, called for the random drug testing of elected officials to ensure that winners are drug-free.

He called on the Department of Interior and Local Government to immediately conduct a nationwide random voluntary drug testing for barangay and SK officials who get proclaimed in today’s election to ensure that they are in the proper frame of mind to govern in their respective areas.

Election victors must set good example by submitting themselves to drug testing procedures to inspire confidence among their constituents both those who voted for them and those who did not.  Only law-abiding citizens can hold public offices, he explained.

He said this call is consistent with RA 9165 Section 36(d) which authorizes random drug testing of current or incumbent officers and employees of public offices. It is a provision that was not voided by the Supreme Court in its decision on November 3, 2008.

"Maaari ang ganitong uri at proseso ng drug testing. Pinapayagan ito ng batas. Walang nilalabag na batas sa ganitong paraan."

This provision is stated as follows: “(d) Officers and employees of public and private offices. – Officers and employees of public and private offices, whether domestic or overseas, shall be subjected to undergo a random drug test as contained in the company's work rules and regulations, which shall be borne by the employer, for purposes of reducing the risk in the workplace. Any officer or employee found positive for use of dangerous drugs shall be dealt with administratively which shall be a ground for suspension or termination, subject to the provisions of Article 282 of the Labor Code and pertinent provisions of the Civil Service Law.”

"Drug testing using urine samples are easy to cheat. The drug test the DILG should use is that which requires hair samples," he added. 

"Mahirap dayain ang hair sample drug testing. Kahit magpakalbo sila, marami pa naman ibang parte ng katawan na puedeng kunan ng hair sample, tulad ng kilay, pilik-mata, bigote, at balbas. Medyo kaduda-duda na kung todo ahit o wax off sila ng lahat ng kanilang buhok."
